Real Estate Law

Although all of us are involved in some aspect of real estate law throughout our lives, it is often one of the least understood branches of the law. I can help you if you are facing foreclosure, making sure to discuss all of the options in an easy to understand manner.

 

Perhaps you would like to invest in real estate and need a partnership or Joint Venture agreement. Maybe you simply want to lease a commercial or residential property and need a little advice as to the form of the lease. Whatever the situation, I can help you deal with it in the simplest and most effective manner.

 

Trusts

If you own real estate or personal property in excess of $150,000 you really must have a trust. A revocable "living" trust is a good way to avoid probate and make sure your loved ones enjoy their legacy. 

 

Unlawful Detainer

When a rental agreement goes bad and the process to evict a tenant begins, you are entering the complicated world of unlawful detainer. I can help both landlords and tenants navigate the minefield of UD and obtain the most satisfactory results possible.

 

Bankruptcy

There is more fear, misinformation and consternation around Bankruptcy than any other area of the law. The fact is, many people wait too long and spend way too much money before chosing to seek the protection of a Bankruptcy filing. Upon filing, the Bankruptcy court cloaks the Debtor in the protection of the Automatic Stay, ceasing all harassing collection attempts and shutting down pending legal proceedings. 

 

Individuals may seek Chapter 7 protection, which quickly eliminates your debts while protecting most, if not all of your possessions. I can get the court to discharge most debts in about four months and do it for a reasonable flat fee.

 

Chapter 13 proceedings take longer, but creditors don't necessarily get any more than in a Chapter 7 proceeding. Chapter 13 protection is available to Debtors who may have very large incomes and not be eligible for Chapter 7. One key aspect to a Chapter 13 filing is the ability to "cram down" unsecured second mortgages on real estate. This amounts to a forced Loan Modification.
